Distance Sales Agreement
ARTICLE 1 – PARTIES

ARTICLE 2 – SUBJECT
The subject of this Contract is the determination of the rights and obligations of the parties in accordance with the provisions of the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts published in the Official Gazette on 27.11.2014, regarding the sale and delivery of the product(s) ordered electronically by the CUSTOMER from the website elifcigizoglu.com, the code, name, quantity, and sales price of which are specified in the invoice in Article 3.
ARTICLE 3 – DETERMINATION OF MATTERS RELATING TO THE PRODUCT, PAYMENT, AND DELIVERY
3.1. PRODUCTS
The basic features of the goods or services are available at elifcigizoglu.com. The prices listed and announced on the site are the sales prices. Announced prices and campaigns will remain valid until they are updated and changed. The taxes of the goods or services subject to the contract are included in the sales price.
3.2. DELIVERY METHOD AND PLAN
The shipment of the ordered product(s) will start within the relevant business days according to its category after custom production is completed by Elif Cığızoğlu. For all orders placed on the website, shipping is free and the shipping fee will be paid by the SELLER.
3.3. DEFAULT INTEREST
Payment for purchased products will be made in advance or by credit card. Therefore, no default interest is applied by the SELLER.
ARTICLE 4 – GENERAL PROVISIONS
4.1. The BUYER declares that they have read and fully understood the preliminary information regarding the basic qualities of the product, the sales price including all taxes, the payment method, delivery details, and the SELLER's full commercial title, address, and contact information on the elifcigizoglu.com website and has given the necessary confirmation electronically.
4.2. The product subject to the contract is delivered to the BUYER or the person/organization at the address indicated, provided that it does not exceed the legal 30-day period. Shipping costs are covered by the SELLER and are included in the product price.
4.3. If the product is to be delivered to another person/organization, the SELLER cannot be held responsible if the recipient does not accept the delivery.
4.4. The SELLER cannot be held responsible for the failure to deliver the product due to any problems encountered by the cargo company. Even if the BUYER is not present at the address during delivery, the SELLER will be deemed to have fulfilled its obligation. Expenses arising from delays or returns caused by the BUYER are the BUYER's responsibility.
4.5. All legal risks, including unauthorized or unlawful use of the credit card, belong to the BUYER.
4.6. If repairs are requested, the periods specified in the Consumer Law and relevant regulations shall apply.
4.7. The SELLER may supply a different product of equal quality and price to the BUYER before the expiration of the performance obligation, provided there is a justified reason.
4.8. If the SELLER cannot deliver the product on time due to force majeure, they must inform the BUYER. The BUYER may cancel the order, and the paid amount will be refunded within 14 days.
4.9. If the bank does not pay the product price to the SELLER due to unauthorized use of payment systems, the BUYER must return the product within 3 days. Shipping costs belong to the BUYER.
4.10. Once the package is received, it is accepted that the delivery company has done its job properly. Damaged packages should not be accepted and a report should be filed.
ARTICLE 5 – REFUND PROCEDURE
5.1. In cases of justified cancellation, the SELLER refunds the collected amount to the relevant bank within 14 days. Installment refunds depend on bank procedures.
5.2. Products approved for return/exchange must be sent back in a separate package without damage. Products that have lost their originality will not be accepted.
ARTICLE 6 – RIGHT OF WITHDRAWAL
6.1. As a rule, the consumer has the right of withdrawal within 14 days. However, since the products sold on our website are custom-made to order, returns are not accepted for these products. This is explicitly stated on the product detail pages.
6.2. If an eligible return situation arises (e.g., defective goods), the product must be unused. Shipping costs will be covered by the SELLER if sent with the contracted cargo company.
ARTICLE 7 – PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED
Unless otherwise agreed, the consumer cannot exercise the right of withdrawal in the following contracts:
- a) Goods/services whose prices fluctuate in financial markets and are beyond the seller's control.
- b) Contracts for goods prepared in line with the consumer's wishes or personal needs (custom measurements, made-to-order tailoring, etc.).
- c) Perishable goods or goods that may expire.
- d) Goods whose protective elements such as packaging, tape, or seals have been opened after delivery; goods unsuitable for return due to health and hygiene reasons.
ARTICLE 8 – AUTHORIZED COURT
In disputes arising from this Contract, Turkish Law is applicable, and Istanbul Courts and Enforcement Offices are authorized.
This Contract has been read, accepted, and confirmed electronically by the parties. Upon placing an order, the BUYER is deemed to have accepted all terms of this contract.
